Terms of Service

These terms govern the publication support services provided by Elsford Publishing LLC ("we", "us") to you ("the author", "the client"). By engaging us, you agree to them.

1. What we do

We provide publication support: journal selection and matching, manuscript readiness review, formatting to journal requirements, submission management, editor correspondence on your behalf, and post-acceptance support.

We do not write, ghostwrite or author research on your behalf. We do not fabricate, alter or manipulate data, results or images. Manuscript refinement covers structure, presentation and compliance with journal requirements. It does not extend to changing your findings.

2. What we do not promise

We cannot guarantee acceptance or publication. Editorial and peer review decisions rest entirely with the journal. Nothing on our website or in our correspondence should be read as a promise that a manuscript will be accepted, accepted within a given time, or accepted by a particular journal.

Any timeframes we give are estimates. Journal review periods are outside our control.

3. Your responsibilities

By engaging us, you confirm that:

  • The work is yours, and you hold the rights needed to submit it
  • All named authors have agreed to submission and to the author order
  • The data and results are genuine and have not been manipulated
  • The work is not under consideration elsewhere, unless you have told us
  • Any required ethical approvals and consents are in place
  • You have disclosed any conflicts of interest and funding sources

You remain the author and are responsible for the content of your manuscript, including the accuracy of anything we help you prepare.

4. Authorship and disclosure

We do not claim authorship and will not be listed as an author. Where a journal or publisher requires disclosure of third-party editorial or submission assistance, you are responsible for making that disclosure, and we will give you whatever details you need in order to do so.

5. Fees and payment

Fees are quoted per project in writing before work begins. Your quote sets out the amount, the payment schedule and accepted payment methods, and forms part of these terms. Invoices are payable on the terms stated in the quote.

Our fees cover our work only. Article processing charges, submission fees and open access fees are set by the publisher and payable by you directly to them.

6. Revisions and cancellation

The revision rounds included are set out in your project quote. Work beyond that scope, including submission to additional journals after a rejection, is quoted separately before we start it.

Either of us may end a project by written notice. You pay for work completed up to that point, and we refund any unused balance you have already paid.

7. Confidentiality

We treat your manuscript, data and unpublished findings as confidential. We do not share them outside the people working on your submission, and we do not use them to train any automated or machine learning system. How we handle personal data is set out in our Privacy Policy.

8. Intellectual property

You retain all rights in your manuscript and research. Nothing in these terms transfers any ownership of your work to us.

9. Disclaimer of warranties

Our services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will result in publication, acceptance, or any particular editorial outcome.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to a project is limited to the fees you paid us for that project.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost funding, lost research opportunities, editorial decisions, rejection, publication delays, or changes to journal policies.

Nothing here limits liability for fraud, willful misconduct, gross negligence, or anything else that cannot lawfully be limited. Some states do not allow the exclusion of certain damages, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless against claims, losses and reasonable legal costs arising from your breach of these terms, or from any claim that your manuscript infringes another party's rights, misstates authorship, or was prepared without a required approval or consent.

12. Governing law and disputes

These terms are governed by the laws of the State of [state], without regard to its conflict of law principles. The state and federal courts located in that state have exclusive jurisdiction over any dispute arising from these terms, and both of us consent to that jurisdiction.

Before starting formal proceedings, we each agree to try to resolve the matter by contacting the other in writing.

13. General

If any part of these terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with your project quote, are the entire agreement between us.

We may update these terms. The version in force when you engage us is the one that applies to that project.
